Manipulating an odometer is not be punished because there is no fraud of technical

statements at all.

This was released recently by the Bundesgerichtshof ( BGH Germany only ) which is

equivalent to US Supreme Court.  ( File # 4 STR 654 / 79 )

Reasons:

A car´s odometer is not a technical statement as referring to paragraph # 268 STR.

But: anybody who manipulates a car´s odometer to achieve a higher wholesale price,

 in case of sale will be sued in a federal lawsuit case because this is  equivalent to a

general betray of a buyer. Up to 5 years imprisonment or a fine will result in such fraud.

Beside it all the seller is forced to take the car back and has to reimburse the price of

the car.
